Service Policy
DNT DYNAMITE DESIGN, LLC – SERVICE POLICY

COMMUNICATION
All project communication and file transfers are handled via email.
Phone consultations are available only to clients who have secured services through a signed agreement and paid retainer.
RESPONSIBILITIES
DNT Dynamite Design is responsible for:
- Delivering agreed-upon graphic design and/or illustration services.
- Maintaining the confidentiality of all client information and never selling or sharing personal data.
- Providing timely communication throughout the project duration.
The Client is responsible for:
- Clearly communicating the service(s) requested.
- Making all required payments on time.
- Supplying accurate, proofread, and approved content (text, reference images, brand assets).
- Ensuring all provided materials are original or properly licensed and do not infringe on existing copyrights or trademarks.
- Indemnifying and holding DNT harmless from any legal claims or liabilities arising from the use of such materials.
AI USE POLICY
Designer’s Use of AI
DNT does not use AI or automated tools in the creation of any sketches, illustrations, or deliverables unless explicitly agreed upon in writing.
Client’s Use of AI
The Client shall not upload, submit, or otherwise provide any of DNT’s artwork, files, sketches, drafts, or final deliverables to any artificial intelligence platform, model, training dataset, or automated tool of any kind. This includes any service that analyzes, generates, or modifies images or other creative content.
Any use of deliverables in connection with an AI system is strictly prohibited unless DNT provides prior written consent. Violation of this restriction may result in DNT pursuing all available legal remedies, including financial compensation for damages.
BILLING & SERVICE TERMS
Each project is individually quoted based on scope, complexity, timeline, file delivery requirements, and intended usage rights.
A quote confirms pricing and scope only. Design work begins after the quote is approved, the service agreement is signed, and the retainer is received.
Standard Services Include:
- At least two (2) initial concepts/mockups
- Up to two (2) rounds of minor revisions
Minor revisions include color changes, font adjustments, or the addition/removal of simple design elements. Multiple edits may be submitted within each revision round.
Additional revisions beyond the two included rounds will be billed separately.
Logo designs are delivered in vector format along with standard file types and full ownership rights.
All other design projects are delivered in flattened formats appropriate for their intended use. Editable source files (such as .AI or .PSD) are not included unless specifically requested and may incur an additional fee.
Quotes are valid for 30 calendar days and are subject to adjustment if the scope of work changes.
RETAINERS, PAYMENTS & REFUNDS
A non-refundable 50% retainer is required to secure services for all projects. Work will not begin until the retainer is received and the service agreement is signed.
For projects valued over $1,000, an automatic payment plan is available. The remaining balance may be billed in scheduled installments via credit card.
Final deliverables and usage rights are released only upon receipt of full payment. In-progress designs may display a watermark and are not authorized for use until that time.
No refunds are provided for services rendered.
OWNERSHIP, COPYRIGHT & USAGE
DNT retains full ownership and copyright of all created illustrations and designs, including the right to showcase completed work in portfolios, online galleries, and marketing materials. Exceptions to either must be requested by the client in writing.
LICENSE AGREEMENTS
Personal Use License
Client receives artwork for personal, one-time use only (e.g., party invitations). The design may not be used for resale or any commercial purpose. Files are provided in formats suitable for this use (e.g., JPG, PNG).
Commercial Use License
Client receives artwork for business or promotional use (e.g., product packaging, resale items, advertisements). Files include appropriate raster and vector formats (e.g., PSD, PNG, AI, EPS). The client purchases a license for limited usage rights; ownership remains with DNT unless explicitly transferred.
Clients should confirm which license applies to their project before work begins to avoid confusion at delivery.
All usage licenses and file transfers are contingent on full payment. Unused or rejected concepts remain the property of DNT and may be repurposed for future projects.
Work for Hire
Full copyright transfer is available upon request and must be agreed upon in writing prior to project start. Work-for-hire arrangements are priced separately and will be reflected in the project quote. Once full payment is received and a copyright transfer is confirmed in the signed agreement, all ownership rights are transferred to the client.
Credit & Attribution
Copyright transfer does not waive the right to authorship credit. For illustration work, Daveia Odoi must be credited as the original illustrator in all published, printed, or distributed forms, unless otherwise negotiated in writing.
ADDITIONAL SERVICES
Printing
DNT acts as a liaison to source high-quality print services. All printing is fulfilled by third-party vendors, and costs are determined separately. Standard turnaround is 2 weeks. Minimum quantity requirements may apply.
Website Design
DNT provides design services for visually compelling, easy-to-use websites hosted on Shopify. Services for other platforms are not offered at this time. Additional charges apply.
LIABILITY & INDEMNIFICATION
The client agrees to indemnify and hold harmless DNT Dynamite Design, LLC from any claims, damages, or legal disputes arising from materials supplied by the client.
All work is provided “as is.” DNT’s total liability, regardless of legal theory or cause, is limited to the amount paid by the client for the services rendered.
DNT is not liable for indirect, incidental, or consequential damages including loss of profits, data, or business interruption.
TERMS & CONDITIONS
DNT Dynamite Design is open to working under a Non-Disclosure Agreement. Clients may submit their own NDA for review or request one from DNT.
Full terms and conditions will be outlined in the individual project agreement provided prior to project start.
By initiating services with DNT Dynamite Design, LLC, the client agrees to abide by this policy and all associated terms.
